01About these terms

These Terms & Conditions ("Terms") apply whenever you engage SKANDA — the brand under which Viknesh Subramanian designs, builds and delivers digital services — to provide work described on this website or in a proposal, quote, or written agreement ("Agreement"). By approving a proposal, making a payment, or asking us to begin work, you ("Client") accept these Terms.

Where a signed Agreement or statement of work covers the same subject and conflicts with these Terms, the Agreement takes priority for that engagement.

02Our services

SKANDA provides digital services for businesses operating globally, including:

  • Custom website design and development
  • Business websites and web applications
  • AI-powered business automation and workflow solutions
  • Customer enquiry and communication automation
  • Digital process automation
  • Custom technology solutions and consulting

The exact scope, deliverables, timeline and price for any engagement are set out in a proposal, quote or Agreement specific to that project. These Terms describe how we work together in general; they do not by themselves create an obligation for SKANDA to perform any specific project until scope and price are agreed in writing.

03Working together

To deliver a project on schedule, we rely on the Client to:

  1. Provide accurate information, content, access and approvals in a timely manner.
  2. Nominate one point of contact authorised to give feedback and sign off deliverables.
  3. Review drafts and respond within the timeframes agreed for the project.

Delays in the items above will generally extend the project timeline by a comparable amount, and previously agreed fees for work already completed remain payable regardless of such delays.

04Fees & payment

Fees, payment schedule and currency are set out in the proposal or invoice for each engagement. Most projects begin with a deposit or first milestone payment before work starts, with the balance due against agreed milestones or on completion.

Cancellations and refunds are governed by our Cancellation & Refund Policy, which forms part of these Terms.

05Ownership & deliverables

Unless the Agreement states otherwise, ownership of final deliverables created specifically for the Client (such as website designs, custom code and written content produced for that project) transfers to the Client once SKANDA has received payment in full for that engagement.

SKANDA retains the right to reuse general know-how, pre-existing tools, frameworks and non-client-specific components across other projects, and may reference completed, publicly launched work — including a link and short description — in its own portfolio and marketing, unless the Client requests otherwise in writing.

06Third-party tools & platforms

Projects often connect to services the Client controls or subscribes to directly — for example hosting providers, domain registrars, payment processors, CRM systems, messaging platforms (such as WhatsApp Business or email providers) and AI or language-model providers. The Client is responsible for its own accounts, subscriptions and compliance with those providers' terms.

SKANDA is not responsible for outages, pricing changes, policy changes or usage charges billed directly by third-party providers, and does not guarantee the continued availability of any third-party service integrated into a project.

07No guaranteed results

Figures referenced on this website — including response-time and revenue examples — are illustrative of outcomes we aim for based on prior experience. They are not a guarantee for any specific business. Results depend on factors outside our control, including the Client's market, existing systems, data quality and how recommendations are implemented.

08Limitation of liability

To the fullest extent permitted by law, SKANDA's total liability arising from any single engagement is limited to the fees paid by the Client to SKANDA for that specific engagement in the three (3) months preceding the event giving rise to the claim.

SKANDA is not liable for indirect, incidental or consequential loss, including lost profits, lost data, or business interruption, except where such liability cannot lawfully be excluded.

09Confidentiality

Each party agrees to keep the other's non-public business information confidential, and to use it only for the purpose of the engagement, both during the project and after it ends.

10Changes to these terms

We may update these Terms from time to time to reflect how our services or this website change. The version in effect is the one published here at the time; material changes will show an updated effective date at the top of this page.

11Governing law

These Terms, and any Agreement entered into with SKANDA, are governed by the law and jurisdiction stated in that Agreement. Where an engagement has no separate Agreement, the parties will agree on applicable law and venue in writing before any dispute is referred to a court or arbitrator.
